Buch outlines code of ethics
INDEPENDENT adjusters should adhere to a 13-point code of conduct and ethics, Cunningham Lindsey Ottawa district manager Dan Buch told the conference.
It applies when they are dealing with insurers and policyholders in possibly fraudulent claims where they have a higher duty of care because of the possibility of litigation.
The points include:
- Policyholders or anyone who has given a statement may request or obtain a copy of statements and documents provided without any charge or delay.
- Adjusters ought not to give legal advice.
- Information including medical, financial, or other records shall not be obtained without written consent of the individual or his legal representative.
- An adjuster will identify himself as an adjuster in all his dealings and shall, if required, fully identify his principals.
- In dealing with insurers they need to represent only one interest and inform their principals of any conflict brought about by dual assignments, interests in the claim, other relationships, or previous knowledge.
